Latarsha Sanders was convicted of killing her two young sons. But the jury deciding her fate never heard extensive evidence about her mental health, including roughly 7,000 pages of psychiatric records created after the killings.
Now, her conviction has been overturned, and she is getting a new trial.
In this Reasonable Doubt discussion, defense attorneys Gerald Griggs and Joshua Schiffer join host Jodi G and forensic psychiatrist Dr. Susan Hatters Friedman to examine what happened during Sanders’ original trial and why the missing mental health evidence matters.
The panel breaks down the prosecution’s argument that Sanders’ actions after the killings, including allegedly cleaning up evidence, showed rational decision-making. Dr. Friedman explains why a person experiencing psychosis can still plan and carry out certain actions, and why those actions alone may not tell us whether someone understood the wrongfulness of what they were doing.
Then comes the bigger question: Why didn’t Sanders’ jury hear the full picture?
From the limitations facing an indigent defense to evidentiary rulings and competing trial strategies, the panel examines how critical information can be kept out of a courtroom and why, as Joshua Schiffer puts it, “Trial is not a search for the truth.”
Watch Reasonable Doubt for a deeper examination of the Latarsha Sanders case, mental illness, criminal responsibility, and what it means to receive a fair trial.
